Muslims Compelled to Rape Because of Culture
A violent gang rapist should have been given a lesser sentence partly because he was a "cultural time bomb" whose attacks were inevitable, as he had emigrated from a country with traditional views of women, his barrister has argued.
MSK, who, with his three Pakistani brothers, raped several girls at their Ashfield family home over six months in 2002, was affected by "cultural conditioning" in the context of intoxification", Stephen Odgers, SC, told the NSW Court of Criminal Appeal yesterday.
MSK, 26, MAK, 25 and MMK, 19, are appealing against the severity of their sentences after they were found guilty of nine counts of aggravated sexual assault in company - a crime carrying a maximum penalty of life imprisonment - against two girls, aged 16 and 17, in July 2002.
MSK and MMK were jailed for 22 years, with a non-parole period of 16½ years, and 13 years, respectively, and MAK for 16 years (12 years non-parole).

Mr Odgers said the new evidence showed that he had a disease, which, combined with alcohol and the cultural conditioning of "a society with very traditional views of women", was "clearly a factor in the commissioning of these offences".
"The applicant was a cultural time bomb," Mr Odgers said. "It was almost inevitable that something like this would happen. His culpability is lessened because of that combination."

I'm not surprised that a sleazy defense lawyer would do it - I'm surprised that the judge bought it. Those guys will be out in less than 2 years. What a joke.

What I find interesting is the difference in the sentences between Canada and the US(I presume this happened in the US) In Canada they proablaby would have got 5 years, at most.The US sentence is comparable to murder sentences here.
But then rape in Canada isn't as bad as the US cause Canadian women are tougher, I guess.

If people of Pakistani/Muslim background are cultural tume bombs, it seems to me that would be a good reason for not letting them immigrate to non Pakistani/Muslim countries.
Curious, though, that their cultural/religious background made them rape, but not refrain from alcohol. Even more curious is the traditional view of women that says it acceptable to rape them.
Could it be that not all cultures are equal?

This seems to have occurred in Australia. Guess the Muslim League will be issuing a press release calling for a fatwa against this blaspheming defense lawyer for saying such things against their religion, eh ?

I wonder what would happen to a couple of drunken Caucasian non-Muslims in Pakistan or Saudi Arabia who might perchance rape some underage Muslim women. The West has to stop being such chumps or there won’t be much of a West left soon if they keep letting other cultures of origin excuse such obvious criminal behavior...a Justice system cannot be multicultural because culture can't be measured nor proven... even if it could only a sniveling sap would bother trying to make it a mitigation for rape.

So profiling Muslims is wrong, because it lumps the innocent in with the guilty. People should be judged according to their actions, not whatever race they happen to be.
At the same time, Muslims -- at least those from countries with "very traditional views of women" -- are "cultural time bombs", and it is "inevitable" that eventually they will rape, assault, or kill a woman.
Seems like a pretty strong argument for racial profiling to me.

Darrell: Actually it's religious (Muslim) or ethnic (Punjabi, Pathan, Sindhi, Baluch) profiling. Race is not relevant. For example, some people in Pakistan are white by any standard, and others are very dark-skinned. And, although most are Muslim, there is a significant Christian minority.
